1. About The Digital Hype®
The Digital Hype® is a digital marketing and web design agency based in Nallasopara East, District Palghar, Maharashtra – 401209, India. We provide web design, e-commerce development, brand identity, social media management, Meta advertising, LinkedIn growth, and video production services.
By engaging our services — whether through our website, via email, WhatsApp, or any other channel — you agree to these Terms of Service. If you do not agree, please do not proceed with an engagement.
2. Services Provided
The Digital Hype® provides the following services, subject to a written project brief, proposal, or retainer agreement:
- Business website design and development (WordPress, Elementor)
- E-commerce store design and development (WooCommerce, Shopify)
- Landing page design and build
- Brand identity design (logo, brand system, style guide)
- Social media management (content creation, scheduling, community management)
- Meta advertising (Facebook & Instagram paid campaigns)
- LinkedIn personal branding and content strategy
- Video production (brand films, reels, music videos, TVCs)
- In-house SaaS products: LeadHub, DineHub
The scope of any individual project is defined in the proposal or brief agreed upon before work commences. Any scope changes must be agreed in writing before additional work begins.
3. Payment Terms
Standard payment structure: 50% advance before work begins — 50% on final delivery.
- Project commencement: Work begins only after receipt of the advance payment (50% of the agreed project fee)
- Final delivery: The remaining 50% is due upon project completion, before handover of final files, credentials, or live site access
- Retainer services: Monthly retainer fees are due in advance at the start of each billing period
- Late payment: Outstanding invoices beyond 7 days may result in work being paused until payment is received
- Revision requests: A reasonable number of revisions is included within scope. Revisions beyond scope will be quoted separately
Payment may be made via bank transfer, UPI, or any agreed payment method. GST will be added where applicable.
4. Intellectual Property
Upon receipt of full payment, all creative work — designs, website code, brand assets, copy, and deliverables — become the property of the client.
- Before full payment: All work remains the intellectual property of The Digital Hype®. The client does not have rights to use, publish, or distribute any work until final payment is received
- Third-party assets: Any stock photography, fonts, plugins, or licensed assets used in the project are subject to their respective licence terms. We will inform you of any such assets and their applicable licences
- Portfolio rights: We retain the right to display completed work in our portfolio, case studies, and marketing materials unless the client requests confidentiality in writing
- Open-source code: Websites built on WordPress, WooCommerce, or other open-source platforms are subject to the licences of those platforms
5. Client Responsibilities
A smooth project depends on collaboration. The client agrees to:
- Provide all necessary content, images, copy, brand assets, and access credentials in a timely manner
- Designate a single point of contact for decisions and approvals
- Respond to review requests within 5 business days to avoid project delays
- Ensure that any content provided does not infringe third-party intellectual property or violate applicable law
- Provide accurate business information and brief materials
Project timelines are estimates based on prompt client cooperation. Delays caused by late content, slow approvals, or scope changes may extend delivery dates.
6. Revisions and Approval
All projects include a standard number of revision rounds as specified in the proposal. The review and approval process is as follows:
- We present work for review at defined milestones
- The client reviews and provides consolidated, specific feedback
- Revisions outside the agreed scope are quoted as additional work
- Written approval (email or WhatsApp) constitutes sign-off at each stage
7. Cancellation and Refund Policy
- Advance payments are non-refundable once work has commenced, as they cover the time and resources allocated to your project
- If a project is cancelled by the client after commencement, The Digital Hype® retains the advance and will invoice for any additional work completed beyond the advance amount
- If The Digital Hype® is unable to complete a project due to unforeseen circumstances, we will provide a fair refund based on the work completed
- Ongoing retainer services require 30 days' written notice to terminate
8. Limitation of Liability
The Digital Hype® provides services with professional care and industry-standard practices. However:
- We are not liable for any indirect, consequential, or incidental damages arising from the use or inability to use our services
- Our total liability in any dispute shall not exceed the total fees paid by the client for the specific project in question
- We are not responsible for downtime, data loss, or security breaches on third-party platforms (including hosting providers, Meta, Google, or any platform we manage on behalf of the client)
- We do not guarantee specific results from advertising campaigns or social media management, as performance depends on platform algorithms, market conditions, and creative factors beyond our direct control
9. Confidentiality
Both parties agree to keep confidential any sensitive business information, pricing, client data, or strategic plans shared during the engagement. This obligation survives the termination of any project or retainer.
10. Governing Law and Disputes
These Terms of Service are governed by the laws of Maharashtra, India. Any disputes arising from or in connection with an engagement shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Palghar, Maharashtra.
11. Amendments
We may update these Terms of Service from time to time. Material changes will be communicated to active clients. Continued engagement after an update constitutes acceptance of the revised terms.
