1. Who We Are

The Digital Hype® is a digital marketing and web design agency based in the Mumbai region, Maharashtra, India, serving clients across India and worldwide. We provide web design, branding, social media management, Meta advertising, LinkedIn growth, and video production services to businesses across India and internationally.

This website is run by The Digital Hype®, led by its founder Ashish Oza, who decides why and how your personal data is processed (the "data fiduciary" under India's DPDP Act and the "controller" under GDPR). You can reach us using the details in sections 12 and 13.

This Privacy Policy explains how we collect, use, store, and protect your personal data when you visit our website or contact us about our services.

2. Data We Collect

When you contact us via our website enquiry form, we collect:

• Name — to address you properly
• Email address — to send you our response
• Phone / WhatsApp number — to follow up on your enquiry
• Project details — what you share in the "About your project" field
• Consent record — the tick box you select before sending, and the date and time you sent the form

The form is delivered to us through Formspree, a form-processing service that handles the submission on our behalf and may process it on servers outside India. We do not use form submissions for any other purpose.

Only if you accept analytics cookies in our cookie banner, we may also collect technical data about your visit:

• IP address (shortened) and browser type
• Pages visited and time spent on site
• Referral source (how you found us)

If you reject analytics cookies, none of this is collected.

3. How We Use Your Data

We use your personal information only to:

• Respond to your enquiry or project brief
• Send you a proposal or quote for services you've asked about
• Follow up on an active project or client relationship
• Improve our website and understand how visitors find us (analytics only, and only with your consent)

We never sell, rent, or share your personal data with third parties for marketing purposes. We do not use your data for any purpose beyond the service relationship you have initiated.

4. Cookies We Use

Our website uses the following types of cookies:

• Functional cookies — essential for the website to operate correctly (navigation, form submission)
• Analytics and advertising cookies — we use Google Tag Manager, Google Analytics and a Google Ads conversion tag (to measure whether our own ads lead to enquiries) to understand how visitors use the site. Under Google Consent Mode v2, all analytics and advertising storage is denied by default, and is only granted after you click "Accept" in the cookie banner. Until then, Google receives no analytics or advertising cookies from your browser.

You can change or withdraw your choice at any time using Cookie Settings in the footer of any page, or through your browser settings. If you reject, nothing beyond essential cookies is set. See our Cookie Policy for full details.

5. Data Retention

We keep your information only as long as we need it, as follows:

• Contact form enquiries that do not lead to a project: up to 24 months after our last contact, then deleted
• Client project and billing records: up to 7 years, because Indian tax and accounting rules require it
• Analytics data: up to 14 months, then removed automatically by Google Analytics

In general, we retain your contact information for as long as is reasonably necessary to:

• Complete the enquiry or project you contacted us about
• Maintain records for any active client relationship
• Comply with our legal obligations under Indian law

If you ask us to delete your data, we will do so within 30 days, subject to any legal retention obligations.

6. Your Rights — India DPDP Act 2023

Under the Digital Personal Data Protection Act, 2023 (India), you have the right to:

• Access — request a copy of the personal data we hold about you
• Correction — request correction of inaccurate or incomplete data
• Erasure — request deletion of your personal data
• Grievance redressal — raise a complaint with us if you believe your data is being processed incorrectly
• Nominee — nominate another individual to exercise your rights in case of incapacitation or death

7. Your Rights — GDPR (EU/UK Clients)

If you are located in the European Union or United Kingdom, you have the following rights under GDPR:

• Right to restrict processing — request we limit how we use your data
• Right to data portability — receive your data in a machine-readable format

Our lawful basis for processing your enquiry is consent (the box you tick on the contact form) together with our legitimate interest in replying to a service enquiry you started. 8. Data Security

We take reasonable precautions to protect your personal data. Enquiry data is received via secure HTTPS connections. We do not store payment card details — all transactions go through third-party payment processors.

While we do our best to protect your data, no transmission over the internet is 100% secure. If you believe your data has been compromised, contact us immediately.

9. Third-Party Services

Your data may be seen by the following services we use. Each has its own privacy policy, and each acts for us or under its own terms:

• Google Tag Manager, Google Analytics and Google Ads — website analytics and advertising measurement, which can only collect data after you accept the cookie banner (Consent Mode v2)
• Meta (Facebook, Instagram, WhatsApp) — if you message us on WhatsApp or interact with our ads or social pages, Meta processes that activity under its own policy
• Apollo — a sales and contact-management tool we may use to store business contact details and manage follow-up on enquiries
• Formspree — receives and forwards your contact form submission to us
• WhatsApp — for client communication (subject to Meta's privacy policy)
• Hostinger — web hosting provider (GDPR compliant)

10. Children's Privacy

Our services are not directed at individuals under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has submitted data through our website, contact us and we will delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be noted by updating the effective date at the top of this page. We encourage you to review this policy periodically.
